Notion for US real estate lawyers

Notion for US real estate lawyers: contract dates, title objections, closing checklists and wire-fraud safeguards, with escrow kept in trust software.

What you add to the standard build

  • Contract dates, calculated and confirmed

A Transaction database with every contract date (effective date, due diligence, financing, title objection, closing), each with its source clause and a second check. A missed contingency date can lose a client their deposit or their remedy.

  • Title commitment and objections

Each exception in the title commitment as a row: what it is, whether it is acceptable, who is resolving it, and the date it was cleared. At closing you can see nothing is outstanding.

  • A closing checklist per transaction

A template checklist for each deal type (purchase, sale, refinance, commercial), with owners, so no step depends on memory. Reconcile the settlement statement against the checklist before closing.

  • Wire-fraud safeguards, written down

A procedure that wiring instructions are verified by a call to a known number and never changed by email, with a record of who verified, when and how. Do not store wire instructions in Notion; record that they were verified.

  • A commercial due diligence tracker

For commercial deals, a request list and findings tracker covering title, survey, zoning, environmental, leases and estoppels, linked to the contract's review period.

The deal is dates, documents and money

A real estate closing is a set of dates that cost money when missed, a pile of documents that must agree with each other, and funds that must reach the right account. Notion suits the first two well and should never hold the third. Build one Transaction database related to Contacts and Documents, and every file gets the same shape.

Real estate practice differs by state: who closes, which forms are standard, what the attorney's role is. This page does not paraphrase any state's rules; follow your state bar and local custom.

Title commitment items

A title commitment lists requirements to be met and exceptions to coverage. Treat each as a row so nothing is lost between the commitment and the policy.

A closing checklist (template)

  1. Contract executed; dates entered, confirmed.
  2. Conflicts checked; engagement signed; client identity verified.
  3. Title ordered; commitment received and reviewed; objections made in time.
  4. Survey, inspection and other reports received and reviewed.
  5. Financing: lender requirements tracked; loan documents received.
  6. Disclosures and settlement figures prepared; checked against the contract.
  7. Wire instructions verified by phone to a known number; recorded.
  8. Funds confirmed; payoffs obtained; settlement statement agreed.
  9. Closing: documents signed; funds disbursed from the trust or escrow account.
  10. Recording arranged and confirmed; follow-up items assigned.
  11. Close-out: executed documents filed; retention date set; matter closed.

Wire fraud is the practice's biggest operational risk

Criminals impersonate parties and send changed wire instructions by email. The defence is a procedure, not a tool: verify by phone to a known number, never act on emailed changes, and record the verification. Build the verification into the checklist so a closing cannot be marked ready without it.

ControlHow
Warn clients earlyState in writing at engagement that you will never change wiring instructions by email
Verify by phoneCall a number you already hold, not one in the email
Record itCheckbox, date and who verified; no closing without it
Do not store instructions in NotionKeep them in the system your procedure designates, restricted
Secure email and MFACompromised mailboxes drive the fraud
EscalationA named person to call and a plan to report quickly to the bank, authorities and insurer

Commercial: a due diligence tracker

CategoryExamples to request and track
Title and surveyCommitment, exceptions, survey, easements
Zoning and land useZoning verification, permits, certificates of occupancy
EnvironmentalReports and any follow-up
Leases and tenantsLeases, rent roll, tenant estoppel certificates, subordination and non-disturbance agreements
Contracts and operationsService contracts, warranties, licences
FinancialOperating statements, taxes, utilities
Entity and authorityOrganisational documents, authority and incumbency

Link each request to the contract's review period, mark items received, record findings and their resolution, and show open items on the transaction page.

Escrow and trust funds stay in accounting software

Closing funds are client money governed by your state's trust accounting rules and belong in software built for it. See why Notion is not a trust ledger.

Where to start

Start with the best way to use Notion for lawyers, then add the Transaction database. Questions we get asked about this

Can real estate lawyers use Notion?
Yes, for transaction tracking: dates, title objections, closing checklists, parties and tasks. Keep escrow and trust funds in accounting software built for them, and keep wire instructions out of the workspace. Real estate practice varies by state, so follow your state bar's rules and local custom.
Should wire instructions be stored in Notion?
No. Wire fraud targets real estate closings. Verify instructions by phone with a known number, record that you did, and keep the instructions themselves in the system your procedure designates, not in a shared workspace page.
Can Notion track closing deadlines?
It can track them and warn you. Calculate contingency and closing dates from the contract, record the clause relied on, and have a second person confirm critical dates. Notion does not read your contract or know your state's rules.
How do I track title commitment exceptions?
Create a Title items database related to the transaction with one row per requirement or exception from the commitment, with its type, status (open, accepted, being cleared, cleared), the person responsible and the date. A view of open items before closing shows what is outstanding.
Who conducts closings, an attorney or a title company?
It varies by state and by transaction. In some states attorneys customarily close; in others title or escrow companies do. Build the system around your role in the transaction and follow your state's rules.
How do I handle 1031 exchanges?
They have strict statutory timelines and requirements, and specialised intermediaries. Track the dates as critical deadlines with the rule and a second check, take advice, and do not rely on a formula. This page does not state the rules.
What belongs in a commercial due diligence tracker?
A request list, items received, findings by category (title, survey, zoning, environmental, leases and estoppels, service contracts), issues and their resolution, linked to the due diligence period in the contract.
How should I store the closing file?
Keep the executed documents in your document system with a naming rule and link them to the transaction. Record the closing date, recording status and retention date, and close the matter with a checklist.
