What do ethics rules require of lawyers using cloud tools?
In the United States, ABA Model Rule 1.6(c) requires lawyers to make reasonable efforts to prevent unauthorised disclosure of client information, and ABA Formal Opinion 477R confirms lawyers may use cloud services if they exercise reasonable care, including in choosing the vendor and understanding how data is protected. State bars have issued their own cloud-computing opinions, and other jurisdictions have their own rules, so check yours.
Reasonable care is not a product certification. It is a process: understand the vendor's security, configure it properly, control access, and document the decision.
What security does Notion provide?
| Control | What Notion states |
|---|---|
| Independent audits | Annual SOC 2 Type II audits; SOC 3 report available |
| Certifications | ISO 27001, with ISO 27701, 27017 and 27018 listed in its help centre |
| Encryption | In transit with TLS 1.2 or higher; at rest with AES-256 |
| Health data | Business Associate Agreement available to Enterprise customers |
| Admin controls | SAML SSO, audit logs and other admin controls on higher plans; customer-managed encryption keys on Enterprise |
These are the vendor's own statements; the reports themselves are available through Notion's Trust Center. Notion is not end-to-end encrypted, which places it in the same category as mainstream workplace suites rather than zero-knowledge tools.
Where are the real risks?
- Pages published to the web, or shared with 'anyone with the link'.
- Guests invited to a page that contains a full database, not just client-safe content.
- Personal workspaces used for firm work, outside firm control.
- Weak authentication: no multi-factor authentication on accounts.
- Integrations and AI features enabled without reviewing what data they can access.
How should a law firm configure Notion?
- 1
Use a firm workspace on a paid plan
Keep firm work out of personal workspaces, and choose a plan with the admin controls you need.
- 2
Turn on strong authentication
Require multi-factor authentication or SSO for everyone.
- 3
Restrict sharing
Limit who can publish to the web and invite guests; review existing public pages.
- 4
Share pages, not databases
Give clients dedicated, client-safe pages with view or comment access only.
- 5
Review integrations and AI
Check what each connection can read, and set firm rules for AI use.
- 6
Document your due diligence
Record why you chose the tool and how it is configured, and review it annually.
What should stay out of Notion?
Depending on your rules and client agreements, some material may need to live in a specific document management system, and client money records belong in dedicated trust accounting software. Many firms use Notion for matter organisation, tasks, deadlines and knowledge, while linking to privileged documents held elsewhere.
Is Notion AI safe for client data?
Notion publishes separate security and privacy practices for Notion AI. Review them, decide which matters AI may be used on, and treat every output as a draft a lawyer must verify.
